1. Ownership of www.monaelisaphoto.com & Photographic Images

This Website is owned and operated by Mona Elisa Photography. All of the photographs featured on this Website were authored, photographed and created by Mona Elisa Photography. Mona Elisa Photography is the sole owner of all the copyrights to the images contained on this Website. 

These images are protected by the Canadian and international copyright law. All of the other content on our Website, including and not limited to, the graphics, design, and look and feel is either owned by Mona Elisa Photography or has been licensed to Mona Elisa Photography and is protected by the Canadian and international copyright law.

2. Your Use of Our Photographs

You can purchase the photographs featured on this Website from Mona Elisa Photography in the form of fine art prints, or other photographic products (known as “Products”) in the online shop. If you decide to purchase our Product(s), you may not reproduce, publically display, transmit, distribute or exploit the Product, or any portion thereof, in any manner, including and not limited to, print or electronic reproduction, or publication, without the prior written consent of Mona Elisa Photography. Products are intended for your personal use only.

You may not use or reproduce a Product in such a manner as to suggest an affiliation with or endorsement by Mona Elisa Photography. You also agree to not resell, relicense, sub-license, redistribute without written permission from Mona Elisa Photography. 

You agree not to modify, alter or otherwise manipulate any Product(s), including and not limited to, adding other material to any Product(s), without Mona Elisa Photography’s prior written consent.

3. Indemnification and Termination Policy

In the event that you reproduce, display, transmit, distribute or otherwise exploit any Product(s), or any portion thereof, in any manner not authorized by Mona Elisa Photography, or if you otherwise infringe any intellectual property rights relating to any  Product(s) or this website, you agree to indemnify and hold Mona Elisa Photography, its subsidiaries, affiliates, licensors and representatives, harmless against any losses, expenses, costs or damages, including reasonable attorneys’ fees, incurred by them as a result of the unauthorized use of any Product(s) and/or your breach of the terms of this Agreement. Your privilege to access and purchase our services depends on your compliance with the following guidelines. We may revoke your privileges to use our service and take any other appropriate measures to enforce our guidelines if violations are brought to our attention. Additional penalties for violations of the Terms of Use of this agreement may include, but are not limited to, providing information to authorities.

5. Payment

To purchase Products through Mona Elisa Photography’s online store, you are required to provide payment through Paypal.

You are responsible for any taxes that you are obligated to pay or that Mona Elisa Photography may collect from you in connection with your purchase. If you do not pay the sales tax or other taxes on a transaction, you will be responsible for any taxes in the event they are later determined to be payable on the sale. Mona Elisa Photography reserves the right to collect the taxes or other related fees from you at any time.

6. Product Availability and Pricing

Mona Elisa Photography may revise or discontinue a Product and Product option at any time without prior notice. All prices are subject to change without notice.

7. Discounts and Promotional Codes

All discounts or promotional codes must be entered at the time of purchase (on the shopping cart page) for the discount/promotion to be applied. Retroactive requests for discounts or promotions will not be granted.

8. Refunds & Exchanges

All our printing is done on demand therefore we cannot offer a refund or exchange for any Product. We are unable to exchange or refund your order because of colour differences between your computer monitor and our professional calibrated printing system. 

If, however, you have been sent the wrong product by mistake (the product received does not match the product that was ordered) simply contact us within 14 days of receiving your order by emailing customerservice@monaelisaphoto.com with:

A detailed description of the problem
Your order number
Some pictures of the issue

Including these things will help us to resolve things quickly. Please allow 1-3 business days for us to get in touch with you. 

We reserve the right to request that you return the product to us and at our discretion; offer an exchange or reprint; issue store credit for items not including shipping; take no action; or, on the rare occurrence (in that we have exhausted all possible solutions and cannot find a resolution), offer a refund. Please ensure the work is packaged appropriately and that it is protected. Ideally, use the original packaging in which the item was delivered, including all protective material. You are responsible for covering the cost of return postage if the goods delivered were as ordered.

9. Shipping & Customs 

Current order processing time is up to 10 business days as every order is printed on demand. We ship every day from Monday to Friday. Shipping to most international destinations takes around 14 business days. Please be aware that shipping times may be longer if your parcel is held for customs inspection in the destination country.

Shipping is done by the carrier selected upon checkout or as agreed upon when we provide a customized quote.

All customs and import fees and taxes are the responsibility of the customer and parcels will be marked as merchandise. We cannot mark any parcel as a gift, or declare a lower value on the customs forms. Please ensure you take into account any potential import taxes and fees before you place your order.

10. Third Party Websites

Users may find other content on our Website that links to the websites and services of our partners, advertisers and other third parties. We do not control the content that may be available on these sites and are not responsible for the practices employed by websites linked to or from our Website. These third-party websites or services may have their own privacy policies and customer service policies.
